Agreement to These Terms

These Terms of Service (“Terms”) govern your use of easyoffer.com (the “Site”) and any services we provide through it. EasyOffer (“we,” “us,” or “our”) is a real estate solutions company that buys houses and land for cash. By using the Site or submitting information to us, you agree to these Terms. If you do not agree, please do not use the Site.

Who We Are and What We Do

We are a property buyer, not a real estate brokerage. We purchase property for our own account and may resell, assign, or hold what we buy. We are not a licensed real estate broker or agent, we do not represent you in a transaction, and we do not list property on the MLS on your behalf.

Nothing on this Site is legal, tax, financial, or real estate brokerage advice. You should consult your own attorney, accountant, or licensed agent before making a decision about your property.

Offers Are Not Binding Until Signed

Any number, estimate, range, or preliminary offer we provide through the Site, by phone, by text, or by email is an expression of interest only. It is not a contract and does not obligate either of us to anything.

A purchase becomes binding only when both parties sign a written purchase agreement. Until then, either party may walk away for any reason. Our written agreements may include inspection periods, title contingencies, and other conditions, and our offer may be revised or withdrawn if what we find during due diligence differs from what was represented.

Information You Give Us

When you submit a form or speak with us, you agree that the information you provide is accurate and that you have the right to provide it. You represent that you either own the property you are telling us about or are authorized to act on the owner's behalf.

How we handle your information is described in our Privacy Policy, which is part of these Terms.

Calls, Texts, and Consent

By submitting your phone number, you consent to be contacted by us at that number, including by automated dialing systems, prerecorded messages, and SMS, about your property and our services. Consent is not a condition of any purchase. Message and data rates may apply.

You can opt out of text messages at any time by replying STOP, and you can ask us to stop calling by telling us so during a call or by emailing hi@easyoffer.com.

Tools, Calculators, and Estimates

The Site offers calculators, market information, and other free tools. These produce estimates from general assumptions and public data. They are provided for convenience and are not appraisals, broker price opinions, or guarantees of value, cost, or outcome. Do not rely on them as the sole basis for a financial decision.

Our Internal Software

We build and operate internal software to manage our own advertising, marketing, and property research. That software is for our own use only. It is not offered, licensed, or sold to anyone outside our company, and we do not manage advertising or marketing on behalf of third parties.

Acceptable Use

When using the Site, you agree not to:

• Submit false, misleading, or fraudulent information
• Submit information about a property you neither own nor are authorized to represent
• Scrape, crawl, or harvest content or data from the Site by automated means without our written permission
• Attempt to gain unauthorized access to the Site, its systems, or other users' information
• Interfere with the operation of the Site, including by introducing malicious code or overloading our systems
• Use the Site for any unlawful purpose

Our Content

The content on the Site, including text, graphics, logos, and software, belongs to us or our licensors and is protected by intellectual property law. You may view and print pages for your personal, non-commercial use. You may not reproduce, republish, or distribute our content for commercial purposes without our written permission.

Third Party Links and Services

The Site may link to third party websites or rely on third party services. We do not control them and are not responsible for their content, practices, or availability. Following a link is at your own discretion.

No Warranties

The Site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error free, or that the information on it is complete, current, or accurate.

Limitation of Liability

To the fullest extent permitted by law, EasyOffer and its owners, members, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any lost profits or lost opportunity, arising out of your use of the Site or reliance on its content. Where liability cannot be excluded, our total liability is limited to one hundred United States dollars ($100).

Indemnification

You agree to indemnify and hold us harmless from any claim, loss, or expense, including reasonable attorney fees, arising from information you submit to us, your breach of these Terms, or your misuse of the Site.

Governing Law and Disputes

These Terms are governed by the laws of the State of Tennessee, without regard to its conflict of law rules. Any dispute arising from these Terms or your use of the Site will be brought in the state or federal courts located in Davidson County, Tennessee, and you consent to the jurisdiction of those courts.

Nothing in this section limits either party's right to seek relief in small claims court where it is available.

Changes to These Terms

We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent revision. Continued use of the Site after changes constitutes acceptance of the updated Terms.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions stay in full force, and the unenforceable provision will be applied to the maximum extent permitted by law.
